Are You Getting Strange Calls Late At Night? WHAT IS CLASSIFIED AS AN EMERGENCY REPAIR?

To save real estate own­ers time and money I have writ­ten this art­icle because of the amount of calls we get late at night by our ten­ants for EMERGENCY repairs to replace fly screens and inter­net connections.

If you are con­sid­er­ing man­aging your own prop­erty in Seven Hills or Toongab­bie, this is a must know or you will be kept awake at night for non emer­gency repairs. We exper­i­ence this at least once a week with our prop­erty emer­gency hotline.

The Res­id­en­tial Res­id­en­tial Ten­an­cies Act 2010 and stand­ard terms of the ten­ancy agree­ment spe­cify that emer­gency repairs are works needed to repair any of the following: -

  1. A burst water service
  2. A blocked or broken lav­at­ory service
  3. A ser­i­ous roof leak
  4. A gas leak
  5. A dan­ger­ous elec­trical fault
  6. Flood­ing or ser­i­ous flood damage
  7. Ser­i­ous storm, fire or impact damage
  8. A fail­ure or break­down of the gas, elec­tri­city or water sup­ply to the premises
  9. A fail­ure or break­down of an essen­tial ser­vice or appli­ance on premises for hot water, cook­ing or heating
  10. A fault or dam­age that makes the premises unsafe or insecure
  11. A fault or dam­age likely to injure a per­son, dam­age prop­erty or unduly incon­veni­ence a res­id­ent of the premises
  12. A ser­i­ous fault in a stair­case, lift or other com­mon area or premises that unduly incon­veni­ences a res­id­ent in gain­ing access to, or using, the premises.

Acts 123A — Mean­ing of “emer­gency repairs”

Repairs that are not within these cat­egor­ies are con­sidered to be routine repairs.

What should the ten­ant do if there is a need for emer­gency repairs?

The ten­ant must give notice of dam­age to the lessor/agent or the nom­in­ated repairer if one is named in the ten­ancy agree­ment, of the need for emer­gency repairs. (Ten­ancy Agree­ment Clause 32)
